Kalshi Inc., the federally regulated exchange for event contracts, has taken a big step—it’s filed a federal lawsuit against the New York State Gaming Commission, in an effort to stop the state from treating its prediction markets as some backroom gamble—basically illegal. The filing, made in Manhattan on October 28, follows a cease-and-desist letter issued on October 24, ordering the firm to stop offering sports-event contracts or face penalties.

Kalshi argues that under the Commodity Exchange Act (CEA), the Commodity Futures Trading Commission (CFTC) has exclusive jurisdiction over its contracts, effectively preempting state gambling laws.

Federal vs. State Jurisdiction Battle

The case intensifies an ongoing conflict between state regulators and federal commodities authorities over who controls the fast-growing prediction-markets industry.
