The fate of spot Ether (ETH) exchange-traded funds (ETFs) could be decided this week by a single vote from Gary Gensler, the chair of the United States Securities and Exchange Commission (SEC). This decision comes after the approval of spot Bitcoin ETFs earlier this year, which was also determined by Gensler’s decisive vote.
In January, the SEC approved spot Bitcoin ETFs with a narrow 3-2 vote. The five-commissioner panel included crypto-friendly commissioners Hester Peirce and Mark Uyeda, who voted in favor, and commissioners Caroline Crenshaw and Jaime Lizárraga, who opposed the approval. Gensler’s vote tipped the balance, leading to the approval of the Bitcoin ETFs on January 10, 2024.
This week, the same five SEC Commissioners are set to vote on VanEck’s spot Ether ETF on May 23. The outcome remains uncertain, with each commissioner’s stance and potential vote being closely watched.
Commissioner Profiles
Hester Peirce
Known as “Crypto Mom,” Peirce is a strong advocate for digital assets and decentralization in the financial system. Although she has not confirmed her vote on the spot Ether ETFs, her participation in the Ethereum community, such as speaking at ETHDenver in February, suggests a favorable inclination.
Caroline Crenshaw
Crenshaw is a notable critic of the cryptocurrency industry. She opposed the spot Bitcoin ETF, citing concerns about fraud and market manipulation. There is no indication that her stance on spot crypto ETFs has changed, making her vote against the Ether ETF likely.
Mark Uyeda
Uyeda, alongside Peirce, has criticized the SEC’s “regulation by enforcement” approach. He voted to approve the spot Bitcoin ETFs, despite expressing concerns about the SEC’s decision-making process. His vote on the Ether ETF remains uncertain, as it is unclear if the same “independent reasons” he cited for approving the Bitcoin ETFs will apply.
Jaime Lizárraga
Lizárraga voted against the spot Bitcoin ETFs and has voiced skepticism about cryptocurrencies as viable financial alternatives. His past comments suggest he is unlikely to support the spot Ether ETF.
Gary Gensler
While Gensler approved the spot Bitcoin ETFs, speculation suggests he might have been compelled by Grayscale’s appeal win against the SEC. His current stance on the spot Ether ETFs remains unknown, adding to the uncertainty of the upcoming vote.
Potential Implications
If approved, the spot Ether ETF will hold Ether directly as its underlying asset, trading similarly to stocks on exchanges. The approval process involves the SEC green-lighting both 19b-4 filings (exchange rule changes) and S-1 applications (registration statements). Delays or denials by the SEC could signal ongoing regulatory concerns about the stability and security of cryptocurrency investments.
Market Reactions
As the decision date approaches, the price of Ethereum has seen a partial recovery, bouncing back to $3,100 over the weekend. Crypto analyst Altcoin Psycho believes the market is underestimating the likelihood and impact of an ETH ETF approval, suggesting that buying ETH under $3,000 before the ETF decision could prove to be a lucrative move in hindsight.
Bloomberg ETF analysts Eric Balchunas and James Seyffart have revised their prediction of at least one spot Ether ETF being approved from 70% in January to 25% this month. This decline reflects increasing uncertainty and cautious sentiment among market participants.
The upcoming SEC decision is crucial, as approval could significantly boost Ethereum’s mainstream adoption and provide a more regulated and secure investment environment. Conversely, a delay or denial might reflect persistent regulatory challenges and concerns within the cryptocurrency industry.
