As the cryptocurrency community awaits the final decision in Ripple’s long-running litigation battle with the United States Securities and Exchange Commission (SEC), the blockchain company has asked the court to seal specific papers.
James K. Filan, a defense attorney and former federal prosecutor, published a document in an X post on May 14 revealing that Ripple has filed a motion to seal key papers related to the SEC’s motion for judgment and remedies.
Confidential Financial Information
Among other things, the court filing sent to Judge Analisa Torres seeks to conceal or redact sensitive information, such as the company’s “negotiated financial terms of its contractual agreements with certain third-party business partners.” Ripple’s proposed redactions are specific and only cover the particular financial and pricing terms that it and some of its current or former counterparties negotiated. The Court previously agreed to Ripple’s identical or similar proposed redactions for both the Summary Judgment and Daubert motions.
Ripple’s chief financial officer, Jonathan Bilich, has submitted a declaration in favor of the company’s application to seal, stating that “Ripple is a private company” that “undertakes significant efforts to protect the confidentiality of its sensitive and proprietary business information.” Bilich emphasized that the disclosure of this information to the public would be detrimental to Ripple’s business relationships with customers and other counterparties, as well as harming Ripple’s competitive standing in the marketplace.
Discounts for Institutional Purchases
According to Bill Morgan, a lawyer and popular commentator on the case, Ripple’s legal team is allegedly attempting to seal certain discounts offered to institutional XRP buyers.
He noted, “A company has every right to seek and protect commercially sensitive information.”
Morgan clarified that his comments were not a criticism of Ripple but an acknowledgement of the company’s right to protect sensitive business information.
SEC’s Remedies Reply Brief
The SEC previously filed its remedies reply brief and supporting exhibits, attempting to justify the need for injunctions. The SEC argued that Ripple’s claims refuting the allegations of reckless behavior were “contrary to evidence.”
In reality, the SEC has accused Ripple of intending “to issue a new unregistered crypto asset,” citing the company’s announcement of the anticipated dollar-pegged stablecoin release on April 4, 2024, as evidence of its ongoing violations.

On the downside, immediate support levels are at $0.50624, $0.47901, and $0.44907, where buyers might step in to stabilize the price.
The Relative Strength Index (RSI) is at 44.65, indicating neutral momentum, while the 50-day Exponential Moving Average (EMA) is at $0.51169, closely aligning with the current price and suggesting stability. These technical indicators and key price levels suggest a balanced market with the potential for both upward and downward movements.
